Itinerant Traders and Home Based Small Businesses

The City of Ballarat has a regulatory role with regards to certain business activities, to ensure that businesses are operating in a manner that is compliant with the requirements of the Ballarat Planning Scheme. Businesses that chose to operate in a non-compliant manner, can have a negative impact on the amenity and activities of those around them.

During 2005, the Council's Planning Enforcement Team had reason to investigate 12 separate itinerant trading sites in Ballarat. Of those investigated, six (6) were found to be in breach of the planning requirements, and were asked to relocate to a more appropriate, compliant site.

Council's enforcement practices have had a very positive result with regards to educating itinerant traders. Those traders now make enquiries with Council, prior to setting up their temporary trading site.

Over the past few years, there has been a steady increase in the number of home based small businesses. Many of these new businesses have been unaware that Council approval must be obtained before business operations can commence. This provision is to ensure that the new business activities do not interfere with the amenity and lifestyle of the residential area.

During 2005, Council has investigated 22 separate home based small businesses. Of those investigated, 15 were found to be operating in a non-compliant manner, and were subsequently closed down.

Council desires to encourage start-up businesses within Ballarat, and has a number of initiatives and programs which are of great benefit to start-up businesses. However, Council support and assistance are only given on the understanding that the business operators are establishing and operating their new business in a law abiding manner.
